Town police say a 51-year-old Flanders man choked a woman during an argument at a Riverhead home early Wednesday, two days after he was ordered by a town judge to stay away from her.

Riverhead cops received a 911 call about a domestic incident at a house on Oakland Drive about 4:20 a.m., according to a police statement. Officers who arrived on scene spoke to the victim, who told police that Howard Cannon had “obstructed her breathing,” according to the press release.

Police learned that the woman had an order of protection against Mr. Cannon that had been issued in Riverhead Town court on Monday. Cops found Mr. Cannon in the road in front of the house with an open 12 oz. can of ICE beer, police said.

As Mr. Cannon was arrested, police say they found he was in possession of marijuana, according to the police statement.

He was taken to police headquarters and charged with felony criminal contempt, misdemeanor obstruction of breath and violations for an open alcoholic beverage and marijuana possession.
