This Santa is the owner of Suffolk Security Systems (Paul Romanelli) and flew here via helicopter as part of The North Fork Chamber of Commerce’s Cutchogue Christmas celebration a few weeks ago.

  • And here we have a prime example of the unintended consequences which occur when an unconstitutional alphabet agency (the FCC) mandates their arbitrary “rules” as law. Think the EPA is bad? Just wait. Please support this family and this town against NextG, and the FCC.

  • I certainly support the homeowner’s request for NextG to remove this eyesore, but what is the FCC’s involvement in this dispute?

  • That is bizarre. Isn’t everyone allowed to use their own property as they see fit. If someone plants something on your property, aren’t you allowed to use that something as you see fit as well?

    And of course, there is the issue of electrical emissions, radiation, etc.

  • The good news is that the pole is being removed from the residence. The bad news is that the whole story about the difficulties this lady went thru to getting it removed was not discussed in this story. The town did not assist her in her originally inquiries about getting this removed and it was not until the town was clearly shown the local laws were they forced to respond. The highway department did not do anyone any favors. They completely ignored this lady’s problems until they were on the verge of being exposed of their lack of response.

Yet they story reinforces the incorrect statement by the property owner that it is in their “yard”. That the DiMarcos believe their yard extends to the street doesn’t make it so.

  • Tim –
    I could get into private property rights vs the state, but that’s a bigger issue. Does the fact that the company putting up the cell tower committed fraud bother you? They misled them by saying it was a street lamp or whatever. Did you not read about the them not obtaining a town permit, etc? There’s no room here to defend the company (or the FCC if they did “approve” this).

  • Emton, the FCC and the PSC set “regulations” for what they deem a “public utility.” Then judges rule on these regulations as if they were the supreme law of the land. See how that works?

  • The North Shore Beach Property Owner Association has several structures in the vicinity of Broadway Ave. and Friendship Drive that do not comply to Town Code and there are no permits filed for them. They have been reported as violations back in April of 2010 and nothing has been done by Mr. Martin Haley other than to give the association special treatment. The corruption in within the Town of Brookhaven needs to be stopped. Now the GOP has chosen Mr. Haley to be their front man to run for Legislature? Should we promote a corrupt individual? I think not.

    No transmission tower shall hereafter be used, erected, moved, or reconstructed, changed, altered or modified to serve as a transmission tower except after administrative approval by the Commissioner of the Department of Planning, Environment and Land Management or upon the issuance of a special use permit(s) by the Zoning Board of Appeals in conformity with the requirements of this article.

    It appears that the Town has the authority to remove this tower, which was installed on the ‘Right of Way’ in front of the homeowner’s property.

    Take a look at how many towers (and especially antenna’s are in Mt. Sinai) – there is even an antenna on top of the Mt. Sinai elementary school ?????

  • It’s a right of way, not an easement. The homeowner has no title to the property.
